Imprisoned Gonabadi Dervish, Mostafa Abdi has complained against judge Salavati to disciplinary prosecutor court of Judges over the violations of law during his case investigation process and the issuance of three year jail sentence by the judge.
According to Majzooban Noor, Dervish rights activist, Mostafa Abdi who is currently being held at Evin Prison’s Ward 350 after being sentenced to three years in prison on charge of “assembly and collusion against national security through cooperating with Majzooban Noor website” by judge Abolqasem Salavati presiding over Tehran’s Revolutionary Court, Branch 15, in a letter of complaint to the disciplinary prosecutor court of Judges by saying that he will not plan to appeal the verdict, revealed violation of law by judge Salavati.
At the beginning of this letter of complaint is quoted: “About the reasons of not appeal against the sentence I should tell that the court of appeals must be a fair hearing court and competence and the neutrality of the judge in trail. The most important is the legal competency of investigating authority that is most important to form the court of law in order to put a defendant on just trial and it is also obvious that in such a case to be investigated the Righteous of court and the judge must be accepted by law, then it is in such a court that , mental and legal security of defendant is provided. Otherwise without these conditions any trial would be meaningless.”
In the following, Mostafa Abdi described the violations of law by judge Salavati such as “the unlawful increase of provisional remedy (his bail bonds salary was changed to a bail of 100 Million Toman) in the final sessions of the hearing”, “not allowing the defender lawyers to attend the court and the lack of review of alleged stewards and assistants’ cases simultaneously”, “judge’s ignorance of the General Principles of Law” and “violation of the principle of neutrality by judge Salavati”. He requested the disciplinary prosecutor court of Judges to get the last plate of this cruelty book off because the ignoring the injustice and illegality will lead the judicial system to fall into depths of the dark valley of injustice and oppression.
It is important to mention that, Abdi asked his attorneys not to appeal the sentence until the Revolutionary Court would comply with the law and overcoming obstacles.
Mostafa Abdi was arrested along with 15 other lawyers and managers of Majzooban Noor website ( Nematollahi Gonabadi Order News Website) two years ago, in Shahrivar 1390 (September 2011) in Tehran and had been released on bail bonds salary after enduring more than one month behind bars in security Ward 209 of Evin prison. On 11th of Bahman 1391 (Jan 30, 2013) he was again summoned to Evin court to post his bail which has been illegally set in the amount of 100 million toman under order from judge Salavati.

He has been twice summoned to appear in Branch 15 of Tehran Revolutionary Court presided over by Judge Salavati to hear his charges and each time he refused to defend himself due to illegal process hearing and stated that, according to article 185 of the Code of Criminal Procedure Public and Revolutionary Courts, the defender lawyer should be allowed to study papers of the client’s case and because the law has not been implemented in his case and also all of his lawyers did not have present in court so he would not defend himself.
Judge Abolqasem Salavati, has sentenced Mostafa Abdi to 3 years in prison on charges of “assembly and collusion against national security through cooperating with Majzooban Noor website” under article 610 of the Islamic Penal Code. He refused to post bail of 100 million toman, then was taken to Section 350 of Evin prison on Esfand 1391 (Feb 2013).
